Terms of Service

The user is advised to read the Terms of Services with the utmost care before visiting bestpoints.com, using the mobile app and any services provided by BestPoints. BestPoints Sp. z o.o. (together with any affiliates, the “Company,” “we,” “us” or “our”) owns and operates a number of mobile apps, websites and interactive services, including but not limited to, Android-based BestPoints and iOS-based BestPoints (the “BestPoints app” or “App”), bestpoints.com. (These Terms of Service (“Terms”) apply to the BestPoints App and to all of the features, emails, online services and other functionalities available via or related to BestPoints.

These Terms constitute a binding contract between you, an individual user (“you”) and the Company governing your use of the Service (as defined below).  BY ACCESSING OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.  IF YOU DO NOT AGREE TO THESE TERMS, THEN YOU MUST NOT ACCESS OR USE THE SERVICE.

  1. Interpretation
    • §1 BestPoints, “we”, “our”, “its” and “us” refer to www.bestpoints.com, the mobile app BestPoints available on devices operating on Android and iOS, its owner and authorized officials
    • §2 “Services” include all the serviced offered by BestPoints. Including but not limited to: www.bestpoints.com; the BestPoints mobile app available on devices operating on Android and iOS.
    • §3 Additional or separate agreement refers to any separate understanding between BestPoints and the user other than or in addition to the Terms of Service.
    • §4 “You”, “client”, “visitor” and “user” refer to any person visiting www.bestpoints.com, using the BestPoints mobile app available on devices operating on Android and iOS and using the services.
    • §5 “Terms of Services” and “ToS” refer to all provisions of these terms of services document.
    • §6 “Privacy policy” refers to the principal position of BestPoints. Describing the ways of collection, use, storage and maintenance of the data and information relating to the user.
    • §7 “Provision” refers to all the sections, sub-sections and proviso herein contained.
  1. Services and warranties:
    • §1 It is the sole responsibility of the client to ensure the observation of the terms and conditions of any contact with a third party.
    • §2 The client agrees not to violate any provision of the contract the client has had with any third party. It is the sole responsibility of the client to ensure that the Terms of Services are not contrary to the contract with a third party. The client represents and warrants that BestPoints is not and shall not be party to such violation.
    • §3 The client agrees not to use the Services for any purpose not compliant with the laws for the time being in force in Poland and with the public policy
    • §4 BestPoints may modify or terminate its services at any time without serving notice, provided that the existing user will be either refunded or served.
    • §5 BestPoints reserves the right to amend, change or modify any provision of these Terms of Services, and the amended, changed or modified terms of services shall be effective immediately after they are posted on www.bestpoints.com
    • §6 BestPoints reserves the right to terminate, amend, modify or make unavailable any part or feature of the provided Services without prior notice to the client.
    • §7 BestPoints may refuse services to any client without providing a reason
    • §8 Client agrees that BestPoints may use whenever necessary third-party services aside from own marketing tools and techniques.
  2. Payments, refunds and cancellation:
    • §1 The user, without contradicting the Terms and Conditions, agrees not to dispute any transaction with BestPoints unless dispute resolution arrangements put forth by BestPoints fail to address the legitimate claims of the client.
    • §2 The client is advised to their own benefit to understand all aspects of the transactions and get an independent legal opinion before making a final decision to subscribe to the services. BestPoints will not be held liable if the client fails to understand these Terms of Service or omits reading them in their entirety.
  1. General terms:
    • §1 The headings, subheadings and numbers in the Terms of Service are for convenience of the reader and reference only, and they aim not to limit, define or determine the scope of the provisions herein contained.
    • §2 BestPoints has its official Privacy Policy posted separately on www.bestpoints.com for the reader’s convenience and to emphasize the need of the reader’s special consideration.
    • §3 If BestPoints fails to enforce any right available and contained in these Terms of Service, any additional agreement or any law being in force for the time being, it shall neither imply that BestPoints waives the right nor is deprived of its entitlement to enforce such a right subsequently.
    • §4 BestPoints offers its services to users having legal qualification (pertaining to age and solvency) to enter an agreement with BestPoints. If you do not meet the criteria of legal qualification, BestPoints hereby advises you not to use the services and disclaims all the liabilities whatsoever.
    • §5 BestPoints may assign any right arising from these Terms of Service to any person or entity. The user agrees not to assign any right available in these Terms of Service to any person or entity.
  2. Registration, user accounts, Security:
    • §1 In order to access all of the Services provided by BestPoints you must affirmatively register for an account on the Service (an “Account”). When you create an Account, you must complete the registration process by providing BestPoints with current, complete, and accurate information, as prompted by the applicable registration form.
    • §2 You acknowledge that in the event you provide any information to BestPoints that is untrue, inaccurate, out of date, or incomplete, BestPoints may terminate these Terms and your continued access to and use of the Service at any time and without any liability to you. This includes by having a lapsed email address on file with BestPoints.  If we attempt to communicate with you via email and the message is rejected as undeliverable, then we may suspend or terminate your account in our sole discretion and without any liability to you.  So please be sure to keep your information up to date.
    • §3 As part of the registration process, your account will be registered by the basic information you provide to us, including your name and email address. We reserve the right, in our sole discretion, to disallow, cancel, remove, suspend or terminate your account, without liability to you or any third party, and with or without prior notice to you including, without limitation, if activities occur on your account that we believe would or might constitute a violation of these Terms, cause damage to or impair the Service, infringe or violate any third party rights, damage the reputation of BestPoints or violate any applicable laws or regulations. You are entirely responsible for maintaining the security and confidentiality of your account and password.
  1. Intellectual property:
    • §1 You acknowledge and agree that: (i) the Service, and, without limitation, any Content, modifications, enhancements, and updates, and any originals and copies thereof, in whole or in part, and all intellectual property rights therein (collectively, “Proprietary Materials”), are owned by BestPoints and its licensors, or by Third Party Services (as defined in Section 16) whose content is accessible from or through the Service, as applicable; (ii) the Proprietary Materials may contain valuable copyrighted and proprietary material of BestPoints and its licensors, or the third party owners thereof, including Third Party Services; (iii) the Proprietary Materials and the Service are licensed, rather than sold, to you pursuant to these Terms; and (iv) you have no rights in the Proprietary Materials, other than the rights and licenses specifically granted to you pursuant to these Terms or by the terms of use of any Third Party Services.
  2. Use of Third-Party content:
    • §1 To ensure the correct functioning of its products, BestPoints utilizes the following material belonging to third parties:

        1. We use the following intellectual property of Valve corporation including but not limited to:
        2. The names: Counter-Strike: Global Offensive, CS:GO, Steam, their logos, in-game images images and names of weapons, weapon skins.
        3. The mentioned elements are the sole property of Valve Corporation and BestPoints does not claim any ownership to them.
      2. BestPoints – Get Robux Gift Cards:
        1. We use the following intellectual property of Roblox corporation including but not limited to:
        2. The name “Roblox”, the game’s logo, images and names of skins, items, the name “Robux”.
        3. The mentioned elements are the sole property of Roblox corporation and BestPoints does not claim any ownership to them.
      3. BestPoints – Get LoL Riot Points & BestPoints – Get Valorant Points:

  1. License:
    • §1 Subject to your complete and ongoing compliance with these Terms, BestPoints hereby grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable, royalty-free license to access and use the Service, solely for your non-commercial use and strictly in the manner set forth in these Terms. Unless otherwise specified in writing, the Service is solely for your personal use and not for resale.
  1. Third-party services:
    • §1 The Service may contain content or information about content, products, and services provided by third parties, and links to third party content or web sites (“Third Party Services”). This content and information and these links for Third Party Services are provided only as a convenience to Users, and may not be appropriate or suitable for all audiences.
    • §2 BestPoints does not review or control the content and information available from Third Party Services or these Third-Party Services, and BestPoints does not make any representations or warranties, express or implied, regarding this content and information or these Third-Party Services. BestPoints is under no obligation to maintain any link on the Service and may remove a link at any time in its sole discretion for any reason whatsoever.
    • §3 BestPoints gives the users access to various Offer walls (a strategy to monetize apps by offering users a list of in-app incentives or rewards which they can get by performing certain actions, such as watching a video or downloading other apps.) provided by our partners. BestPoints does not review or control the content and information available there. Inclusion of any of the foregoing in the Service does not constitute or imply an endorsement, authorization, sponsorship, or affiliation by or with Current with respect to any third party or its web site or content, or any information, products, or services provided by that third party.
    • §4 YOU LISTEN TO AND CONSUME ALL CONTENT ON THIRD PARTY SERVICES AT YOUR OWN RISK, AND IF YOU ARE EASILY OFFENDED BY MATURE, CRUDE, RUDE OR INAPPROPRIATE CONTENT, THEN YOU SHOULD NOT USE THE SERVICE OR CHOOSE THE THIRD-PARTY SERVICES YOU LISTEN TO CAREFULLY. THIS APPLIES EVEN MORE SO IF YOU ARE ACCESSING THIRD PARTY SERVICES WHILE IN THE PRESENCE OF MINORS. YOU INDEMNIFY AND HOLD BESTPOINTS HARMLESS FROM ANY LIABILITY ARISING FROM YOUR USE OF THE THIRD-PARTY SERVICE.
  1. Unauthorized use:
    • §1 You understand and agree that you will not use the Services to engage in the prohibited conduct below:
      1. You shall not use the Services for any illegal purpose, or in violation of any local, state, national, or international law, including, without limitation, laws governing intellectual property and other proprietary rights, data protection and privacy, and import or export control
      2. You shall not post, store, send, transmit, or disseminate any information or material which infringes any patents, trademarks, trade secrets, copyrights, or any other proprietary or intellectual property rights
      3. You shall not use the Services in any way to monitor or evaluate the availability, performance or functionality of the Services for any competitive purpose, or perform or assist any other party to perform any benchmarking on the Services
      4. You shall not attempt to use any method to gain unauthorized access to any features of the Services
      5. You shall not directly or indirectly decipher, decompile, remove, disassemble, reverse engineer, or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Services, security-related features of the Services, features that prevent or restrict use or copying of any content accessible through the Services, or features that enforce limitations on use of the Services, except to the extent applicable laws specifically prohibit such restriction
      6. You shall not directly or indirectly modify, translate, or otherwise create derivative works of any part of the Services
      7. You shall not directly or indirectly copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder
      8. You shall not create and use multiple accounts on the BestPoints platform.
      9. The use of Third-party programs such as VPNs or adblockers is strictly prohibited while using the BestPoints platform
      10. You shall not attempt to scam, deceive, abuse or exploit the BestPoints platform and its authorized officials to your advantage
  1. Consent to Electronic Communications
    • §1 By using the Service or providing Personal Information (as defined in the Privacy Policy) to us, you agree that we may communicate with you electronically (e.g., by posting a notice on the Service or sending an email to you) regarding security, privacy, and administrative issues relating to your use of the Service as well as to keep you informed about the Service. If we learn of a security system’s breach, then we may attempt to notify you electronically by Posting a notice on the Service or sending an email to you, if we have your email address.
    • §2 By using the Service, you agree to receive Messages and Notifications regarding your use of the Service. While Messages and Notifications are intended to enhance your use of the Service, you may disable push notifications on your device and request the removal of your data from our mailing list by messaging support@bestpoints.com
  1. Notice and Procedure for Making Claims of Copyright or Other Intellectual Property Infringements:
    • §1 BestPoints respects the intellectual property of others and takes the protection of intellectual property very seriously, and we ask our Users to do the same. Infringing activity will not be tolerated on or through the Service.
    • §2 If you believe that any content made available on or through the Service has been used or exploited in a manner that infringes an intellectual property right you own or control, then please promptly send a “Notification of Claimed Infringement” containing the following information to support@bestpoints.com Your Notification of Claimed Infringement may be shared by BestPoints with the User alleged to have infringed a right you own or control, and you hereby consent to BestPoints making such disclosure. Your communication must include substantially the following:
      1. Identification of works or materials being infringed, or, if multiple works are covered by a single notification, then a representative list of such works;
      2. Identification of the specific material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit BestPoints to locate the material;
      3. Information reasonably sufficient to permit BestPoints to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted;
      4. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and
      5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
    • §3 If you receive a notification from BestPoints that material made available by you on or through the Service has been the subject of a Notification of Claimed Infringement, then you will have the right to provide BestPoints with what is called a “Counter Notification.” To be effective, a Counter Notification must be in writing, provided to BestPoints and include substantially the following information:
      1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
      2. A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and
      3. The subscriber’s name, address, and telephone number.
    • §4 If you submit a Counter Notification to BestPoints in response to a Notification of Claimed Infringement, then BestPoints will promptly provide the person who provided the Notification of Claimed Infringement with a copy of your Counter Notification and inform that person that BestPoints will replace the removed User Content or Feedback or cease disabling access to it in 10 business days, and BestPoints will replace the removed User Content or Feedback and cease disabling access to it not less than 10, nor more than 14, business days following receipt of the Counter Notification, unless BestPoints receives notice from the party that submitted the Notification of Claimed Infringement that such person has filed an action seeking a court order to restrain the User from engaging in infringing activity relating to the material on BestPoints’s system or network.
  1. Term and Termination:
    • §1 The term of these Terms (the “Term”) will commence on the date on which you first access or utilize the Service in any way (the “Effective Date”) and will continue so long as you continue to access or utilize the Service; provided that BestPoints reserves the right to take whatever lawful actions it may deem appropriate in response to actual or suspected violations of these Terms including, without limitation, the suspension or termination of the User’s access and/or Account, or blocking the User from access to the Service. BestPoints may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong. Except as may be expressly limited by the Privacy Policy, BestPoints reserves the right at all times to disclose any information that BestPoints deems necessary to satisfy any applicable law, regulation, legal process, or governmental request, or to edit, refuse to Post, or remove any information or materials, in whole or in part, in BestPoints’ sole discretion.
    • §2 BestPoints may terminate your Account at any time for a breach of these Terms with or without notice.
    • §3 Amounts that accrue or are due to you before termination of your use of or access to the Service will continue to be payable to you, and amounts owed to BestPoints at the time of such termination will continue to be owed by you after such termination. Upon termination your Account will be terminated and any information about you in such Account will be subject to our data retention practices as described in BestPoints’ Privacy Policy.
  1. Disclaimer of Warranties:
    • §1 TO THE FULLEST EXTENT PERMITTED BY LAW:
      1. THE SERVICE IS PROVIDED “AS IS” WITH ALL FAULTS, AND THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT IS WITH YOU. YOU ACKNOWLEDGE THAT, BECAUSE OF THE NATURE OF THE INTERNET, MOBILE NETWORKS, AND THE DEVICES WHICH ACCESS THE INTERNET AND/OR MOBILE NETWORKS, THE SERVICE MAY NOT BE ACCESSIBLE WHEN NEEDED, AND THAT INFORMATION, DATA, AUDIO, AND VIDEO TRANSMITTED OVER THE INTERNET AND/OR MOBILE NETWORKS MAY BE SUBJECT TO INTERRUPTION OR THIRD-PARTY INTERCEPTION AND MODIFICATION. BESTPOINTS DISCLAIMS ANY AND ALL WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, ACCURACY OF INFORMATIONAL CONTENT, OR NON-INFRINGEMENT; AND ANY WARRANTY ARISING OUT OF A COURSE OF DEALING, USAGE, OR TRADE. BESTPOINTS DOES NOT WARRANT THAT THE SERVICE OR ANY PORTION OF THE SERVICE OR ANY CONTENT OFFERED THROUGH THE SERVICE, WILL BE SECURE, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS, AND BESTPOINTS DOES NOT WARRANT THAT ANY OF THOSE WILL BE CORRECTED. NONE OF THE BESTPOINTS PARTIES WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF THE SERVICE. BESTPOINTS CANNOT AND DOES NOT ASSUME ANY RESPONSIBILITY FOR ANY LOSS, DAMAGES, OR LIABILITIES ARISING FROM THE FAILURE OF ANY TELECOMMUNICATIONS INFRASTRUCTURE OR THE INTERNET, OR FOR YOUR MISUSE OF ANY OF CONTENT AND INFORMATION ACCESSED THROUGH THE SERVICE. BESTPOINTS IS NOT RESPONSIBLE FOR ANY DAMAGE THAT MAY RESULT FROM YOUR USE OF THE SERVICE AND YOUR DEALING WITH ANY OTHER USER. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE AND YOUR RELIANCE UPON ANY OF THE PROPRIETARY MATERIALS, THE SERVICE, OR THE CONTENTS THEREOF IS AT YOUR SOLE RISK AND THAT BESTPOINTS IS NOT RESPONSIBLE FOR ANY DAMAGE TO YOUR PROPERTY (INCLUDING YOUR COMPUTER SYSTEM OR MOBILE DEVICE USED IN CONNECTION WITH THE SERVICE) OR ANY LOSS OF DATA, INCLUDING USER CONTENT.
  1. Limitation of Liability:
    • §1 TO THE FULLEST EXTENT PERMITTED BY LAW:
      1. EACH USER IS SOLELY RESPONSIBLE FOR (I) HIS OR HER USE OF THE SERVICE; AND (II) ANY DAMAGES INCURRED BY HIM OR HER OR ANY THIRD PARTY THAT ARISE FROM OR ARE RELATED TO THE SERVICE. THE AGGREGATE LIABILITY OF THE PARTIES FOR ANY DAMAGES, WHETHER ARISING IN CONTRACT, OR ANY OTHER THEORY OF LIABILITY, WILL BE LIMITED TO ACTUAL DAMAGES PROVED, AND WILL NOT EXCEED THE AMOUNT PAID BY YOU TO BESTPOINTS FOR THE SERVICE. TO THE FULLEST EXTENT PERMITTED BY LAW, AND NOTWITHSTANDING ANYTHING TO THE CONTRARY SET FORTH HEREIN, NONE OF THE PARTIES WILL BE LIABLE FOR ANY PUNITIVE, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, EVEN IF BESTPOINTS OR ITS CONTENT PROVIDERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
      2. YOU REPRESENT THAT YOU HAVE INDEPENDENTLY INVESTIGATED THE ADVISABILITY OF USING THE SERVICE AND THE POSSIBLE RISKS INVOLVED IN USING THE SERVICE. YOU AGREE TO MAINTAIN YOUR OWN INSURANCE COVERING SUCH RISKS AND WILL LOOK SOLELY TO SUCH INSURANCE FOR REIMBURSEMENT OF ANY RESULTING DAMAGES.
  1. Force Majeure:
    • §1 BestPoints will not be liable for any delay or failure to perform any obligation herein if the delay or failure is due to unforeseen events that are beyond BestPoints’ reasonable control, such as, by way of example and not limitation, strikes, blockade, war, terrorism, riots, natural disasters, epidemic, or governmental action, in so far as such an event prevents or delays BestPoints in fulfilling its obligations hereunder.
  2. Indemnification:
    • §1 The user herby agrees to indemnify and hold BestPoints its directors, affiliates, agents, employees and staff harmless from any claim, legal action, demand or damages made by any third party arising from or linking to the user’s use of Services, or violation of these Terms of Services committed as an act of omission or commission of the user or infringement of rights of third party arising out of any contract with such third party.
  3. Third Party Services
    • §1 The Service may contain content or information about content, products, and services provided by third parties, and links (including, but not limited to, advertisements and sound recordings of musical works) to third party content or web sites (“Third Party Services”). This content and information and these links for Third Party Services are provided only as a convenience to Users, and may not be appropriate or suitable for all audiences. BestPoints does not review or control the content and information available from Third Party Services or these Third-Party Services, and BestPoints does not make any representations or warranties, express or implied, regarding this content and information or these Third-Party Services. Inclusion of any of the foregoing in the Service does not constitute or imply an endorsement, authorization, sponsorship, or affiliation by or with BestPoints with respect to any third party or its web site or content, or any information, products, or services provided by that third party. BestPoints is under no obligation to maintain any link on the Service and may remove a link at any time in its sole discretion for any reason whatsoever.
  1. Dispute Resolution
    • §1 In the interest of resolving disputes between you and BestPoints in the most expedient and cost-effective manner, you and BestPoints agree that any dispute arising out of or in any way related to these Terms or your use of the Service will be resolved by binding independent arbitration.
    • §2 In the case of a failure of the independent arbitration to resolve a dispute, the matter may be brought before the court having the competent jurisdiction in Świdnik, Poland.
    • §3 The user expressly agrees that these Terms of Service shall be governed by the relevant laws for the time being in force in Poland.
    • §4 The courts having competent jurisdiction in Świdnik, Poland shall have exclusive jurisdiction to hear the disputes arising from these Terms of Service.
    • §5 Any and all notices and correspondence required to be made by these Terms of Service or by the relevant law for the time being in force in Poland shall be presumed to be delivered if sent to the official email of BestPoints Ltd. (support@bestpoints.com) or any authentic postage service.
